What Are Unfair Debt Collection Practices?
The FDCPA does not apply to individuals or businesses who are attempting to collect debts on their own behalf. However, it does apply to collection agencies and others whose regular business is collecting debts on another’s behalf.
The FDCPA states that debt collectors may not:
- Contact you if you are represented by an attorney
- Contact you if you inform them in writing to stop
- Contact you at work, if they know it will get you in trouble
- Contact you before 8 a.m. or after 9 p.m. (your local time) without your consent
- Contact your neighbors, family members or friends about your debt
- Use or threaten violence
- Use obscene language
- Call without a pause or without identifying themselves on the phone
- Make false or misleading statements
- Threaten criminal prosecution
